These Terms of Services ("Terms") govern your access to and use of the website and services provided by ECS Express Company Limited ("ECS Express," "we," "us," or "our"). - "Services" refers to customs clearance, freight, and logistics services provided by ECS Express.
- "Client," "you," "your" refers to the person or entity engaging our services.
- "Shipment" refers to any goods consigned to us for transport or clearance.
2. Use of Our Services
You agree to provide accurate, complete, and lawful information when requesting quotations and booking services. You authorize us to act as your logistics and customs representative where applicable.
3. Quotations and Pricing
All quotations are valid for the period stated on the quote and are subject to change based on carrier rates, fuel surcharges, customs duties, and other factors outside our control. Unless otherwise agreed in writing, quotations do not include duties, taxes, or storage fees.
4. Client Responsibilities
- Ensure all shipments are lawful and properly declared;
- Provide complete and accurate documentation (invoices, packing lists, permits, certificates);
- Ensure goods are packaged suitably for transport;
- Pay all agreed charges, duties, and taxes on time.
5. Prohibited Goods
We will not handle goods that are illegal, contraband, or restricted without proper authorization. The Client is solely responsible for any consequences of shipping prohibited or misdeclared goods.
6. Payment Terms
Invoices are due within the terms stated on the invoice. Late payments may incur additional charges or suspension of services. All fees are stated in the agreed currency unless otherwise noted.
7. Liability and Limitation
ECS Express acts as a logistics service provider and is not the carrier of goods except where stated. Our liability for loss or damage is limited to the maximum extent permitted by law and by the terms of the carriers and conventions applicable to each shipment (e.g., CMR, Hague-Visby, Montreal Convention). We strongly recommend the Client obtain cargo insurance.
8. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, port congestion, customs actions, government regulations, or disruptions to transport networks.
9. Intellectual Property
All content on this website, including logos, text, and design, is the property of ECS Express and may not be reproduced without our written permission.
10. Confidentiality
We treat your business and shipment information as confidential and will not disclose it except as required to perform the services or as required by law.
11. Governing Law
These Terms are governed by the laws of the Kingdom of Cambodia. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Phnom Penh, unless otherwise agreed in writing.
12. Changes to These Terms
We may revise these Terms at any time. Updated Terms take effect when posted on this page. Continued use of our services constitutes acceptance of the revised Terms.
